The Ministry of Labor has developed amendments to the Labor Code. They explain questions about the norm of working hours for employees, the exercise of the right to leave upon dismissal and the calculation of the duration of vacations. This is reported by Rossiyskaya Gazeta.

Ivan Solovyov, Doctor of Law and Honored Lawyer of Russia, in an interview with the publication recalled that the normal working time cannot exceed 40 hours per week. This is stated in Article 91 of the Labor Code of the Russian Federation. A new change will be the explanation that the normal working time is 8 hours of daily work (shifts), the lawyer explained.

Article 120 of the Labor Code of the Russian Federation establishes that the duration of annual paid vacations of employees is calculated in calendar days and is not limited to the maximum limit. Non-working holidays that fall during the vacation period are not included in the number of calendar days of paid vacation. As Solovyov explained, the new draft establishes that the number of days of paid leave will now be calculated by dividing the full duration of the leave by 12 months.

Article 127 of the Labor Code explains that upon dismissal, an employee is paid monetary compensation for all unused vacations. The amendments explain that an employee who has worked at least 11 working months a year should be compensated in the amount of average earnings for the period of full leave.

Solovyov concluded that, in general, all the clarifications relate to issues that most often become the subject of a dispute between an employer and an employee.
