The state security agency is now investigating charges of incitement to hatred and the use of symbols of unconstitutional organizations. According to the police to the “NDR”, the slogans “Germany for the Germans” and “Foreigners out” are punishable by law – especially with regard to the recent verdict against AfD leading candidate Björn Höcke.

In the Sylt video you can see that an implied Hitler salute was combined with a wave. Together with the suggestion of the mustache, this could also be an anti-constitutional sign. If the accused are found guilty of incitement to hatred (Section 130 of the Criminal Code), they must expect a prison sentence of at least three months and a maximum of five years, provided they are 21 years of age or older.

18 to 20 year olds are considered adolescents who, depending on their level of personal development, are punished either under juvenile or the harsher adult criminal law. If the accused are convicted of using the symbols of unconstitutional organizations, a prison sentence of up to three years or a fine is possible.
