According to the current legal situation, only one woman can be registered as the mother in the case of joint parenthood. A lesbian couple from Berlin now wants to change this and is taking legal action before the Federal Constitutional Court in Karlsruhe.

Shared motherhood: A lesbian couple has filed a lawsuit with the Federal Constitutional Court. As reported by “Zeit”, the couple’s goal is to register both women as the parents of their child. Joint maternity is not possible under the current legal situation. Because: So far only the woman is the mother of the child who gave birth to it.

Adoption only solution? The plaintiffs’ child was conceived with a sperm donation – from a legal point of view, it only has one mother. The only possibility of joint motherhood would currently be adoption by the woman who did not carry the child to term.
