a few years ago talking young progressive Russians that a lot of work can be performed remotely, without prejudice to the result, perceived as a freak – hell, all go to offices and sit there from 9 to 18 hours, and what are you doing?! However, the coronavirus pandemic of even the most conservative segments of the population were forced to chase the progress on udalenku moved millions of people, and about a quarter of them left with many questions – not only employers, but also to legislation. To answer them, it was necessary to prepare a bill on amendments to the Labour Code of the Russian Federation – if the document is adopted, from 1 January 2021 is going to be a normal variant, and not an indulgence or an “opportunity to stay home for the money.”

– until recently, it seemed to us fantastic, but this is our life now, – said the Deputy MHD Stepan Orlov, opening the discussion about working remotely. – Coronavirus revealed the need to handle the problem of remote operation and to prepare the necessary documents. It is noteworthy that the discussion has become nationwide: this is a question that directly concerns millions of people.

In turn, Deputy Chairman of the Federation Council Andrey Turchak noted that the situation with which we are faced, as never before, revealed many issues: will not only allow people to work remotely, but also to develop the behavior in any case.

– During a pandemic, millions of people have been translated into udalenku, and for most of them it was first experience. Every fourth employee believes that his or her rights during a pandemic have been violated, respectively, the experience was negative. However, you need to understand that remote work in the future will only spread. In those areas where experience has been successful, discuss the continuation of the remote work regardless of the pandemic. And if the working distance increases, their rights must be protected. It was decided to hold a series of public discussions of this project, to everyone the Russians could become a co-author, explained Turchak.

Among the nuances to be considered, a lot of purely household – those of which didn’t even occur to you to think people used to work from 9 to 18 hours. For example, it is assumed to expressly provide that the employee-distinzioni has the right not to be in touch around the clock – it’s no secret that during a pandemic provocative “In touch 24/7!”, who liked to flaunt workaholics, for many, was not too pleasant reality. It is therefore necessary to prescribe in law the right of an employee on personal time, and to pay in full during the transition to udalenku (if the volume does not change).

the Next question is tompensate employees costs associated with the use of necessary office equipment (computers, recorders, printers, etc.) and resources (telephone traffic, Internet). As noted by the Deputy of the State Duma Andrei Isayev, now all amendments collected in Chapter 49.1 of the Labor code of the Russian Federation, and the Parliament still has significant serious revision of the bill.

– it is Expected that we will have spelled out three main options – permanent remote work (this concept already existed since 2013), temporary transfer to remote job or combined job (part time out of the office part of the house). Accordingly, the nuances will be discussed depending on the format, explained Isaev.

talking about the fact that, for example, during temporary transfer to remote work to ensure that the employee’s equipment needs and the employer, but at a constant distance collaboration, the man himself has to understand what job he takes – and that it would be good to have at least your own laptop. The same applies to the costs of Internet access and mobile communication: it is no secret that working remotely people often cooperate with 2-3 employers, therefore, the question of who should pay for connection, remains open. Ideally, this question should be settled in the employment contract.

in addition, the translation on the remote work opens a new legal conflict. For example, as explained by the authors of the bill, working remotely the employee cannot be fired for the appearance of the workplace in a drunken state – because it would be impossible to notice and prove. But there will be a new clause: for example, the risk of dismissal for unreasonable prolonged contact.

However, in July of 2020 is already impossible to ignore the obvious: telecommuting – not the future but the present. Their position was expressed by the speaker of the Moscow city Duma Alexey Shaposhnikov:

– what are the advantages of remote working for Moscow? It reduces traffic on the roads. And this, in turn, leads to a decrease in the number of accidents and to improve the environmental situation, the solution to many logistical problems, or mobility the rest of the population, and many other positive aspects. Remote work will give a new impetus to the decentralization of Moscow, will reduce the circular migration of citizens and to increase the attractiveness of areas. For many employers, this format is a cost-effective solution. In particular, the savings on rental space, maintenance of buildings, transportation costs. For employees, the obvious advantage is the flexible schedule, the possibility of saving transport costs and time.

Shaposhnikov said that working on udalenke the number of hospital significantly less. There is nanatee explanation: often flu and colds occur so that to carry out their professional duties of people in the state, but to ride the subway or to drive him extremely desirable.

If all goes well, the bill, the State Duma adopts in the autumn session, and, therefore, from 1 January 2021 the new rules will start to operate.
