The Ministry of labour and social protection has prepared a draft law “On peculiarities of legal regulation of labor relations in 2020” to facilitate communication between the employer and employees during a pandemic coronavirus. This writes belongs to Grigory Berezkin RBC.
Among other things, the draft proposes to prohibit in the conditions of a pandemic to dismiss the employee or send it in a plain at the initiative of the employer. Termination of employment is encouraged to write possible only by the employee or by agreement of the parties. At the same time the Agency proposes to give the employer the right to transfer the employee without his consent is not conditioned by employment contract working for the same employer for up to three months
The Ministry also proposes to set the rate at which in the event of a downsizing organization, employees will continue to work, and dismissal will occur on the next working day after the end of the restrictive measures.
The Ministry clarified that the document is a compendium of suggestions that came “from all sides of social partnership”. If approved, it will apply only to the year 2020.
At the end of March the President of Russia Vladimir Putin declared about the occurrence in the country holidays with the preservation of employees wages and jobs. Officially, the ban on dismissal for reasons connected with coronavirus, is not enshrined in laws or legal acts. In turn, the first Deputy Chairman of the Federation Council Committee on social policy Valery Ryazan said that the presidential decree on the regime of non-working days includes the prohibition of dismissal of employees.
On the website of the Ministry of labor explained that now is not the time to dismiss employees only within those institutions subject to the regime of non-working days, and workers are not working.
