Scotland has more paths to independence, Westminster would be considered legitimate. The referendum in 2014 will never repeat.
the UK never voluntarily will not give up to a third of its land, much of its resources, fisheries, mineral resources, and its beef demand, fruits and whiskey, much of its potential for renewable energy, a vital part of the armed forces, including a nuclear base, from the best universities in a number of key areas. Prime Minister Boris Johnson honest this time, saying that his priority is the unification of the Union. It is a priority of the entire British establishment.
Former Prime Minister David Cameron agreed to the referendum in 2014, because he thought that his result would destroy Scottish nationalism. At the time the independence vote 28% of the population.
However, Westminster got a shock, when during the campaign, support for independence increased to 45%, since many for the first time in my life heard real arguments. Panic Whitehall during the campaign of the referendum in 2014 — is clearly not something that will be decided to repeat the British establishment.
Some people lead a naive argument that if the public opinion polls support for independence will increase to 60%, Johnson and Westminster will have to “hold” a referendum. However, if support for independence will be 60%, the last thing the tories will do is agree to a referendum, which it certainly will lose. They only increase their resistance. This party has no MPs in Scotland, but in Westminster it is represented from the 73 deputies. Johnson has nothing to lose politically, having lost popularity in Scotland. In England his position against the Scots is very popular thanks to the support of poorly educated racists.
foreign Minister Dominic Raab, speaking on television, presented on “intellectual justification” of this position, regardless of the wishes of the majority in Sotlandii, the UK is obliged to prevent Scottish independence to prevent the development of anarchic separatist movements throughout Europe; he was referring to Italy, France and Spain.
Westminster will never agree to another referendum. And there is hardly any option for a “legitimate” referendum through the courts. If the court decides that the consultative referendum law, in accordance with the law of Scotland, the tories will simply adopt a new law in Westminster — and it will become illegal. They’ve done that in Westminster to overrule the decisions of the Scottish Parliament. The UK Supreme court has made it clear that the sovereignty of Parliament cannot be argued with.
Scotland may become independent, but independence would be illegal from the point of view of UK legislation.
the Westminster has no right
If you believe in Scottish independence, you believe in the fact that the Scottish nation is a “people” within the meaning of the UN Charter, and it has the inalienable right to self-determination. This means that Westminster has no right, in accordance with the law, or by any other means, interfere with the independence of Scotland.
Fact: if you believe that Scotland should move towards independence only through a process approved by Westminster, so you do not believe in the independence of Scotland.
Which brings us to Nicola Sturgeon, leader of the Scottish national party and first Minister of Scotland. Its shameful, sensational speech on how to develop further, after breccia, explicitly stated that any referendum should be conducted with the agreement of Westminster, otherwise it will be “illegal”. She used the word “illegal” to denigrate the very idea of Scotland, acting without the permission of Westminster.
Even the most loyal to the Sturgeon independent bloggers, such as James Kelly and Paul Cavanagh, was unable to support her in this matter.
That that, she said, is tantamount to recognition of the legitimate and inviolable sovereignty of great Britain over Scottish people. She recognizes that the Act of Union has done away with the right to self-determination.
When Sturgeon spoke about the convening of the constitutional Convention, it caused at first a laugh, then surprise when she outlined potential membership — the elected representatives of Scotland, among whom are members of Parliament, (former) members of the European Parliament and Council leaders.
Donald Tusk, former President of the EU, outlined the path for independence of Scotland, which recognizes the international community. He confirmed everything that was already said by the experts about the huge sympathy in the EU for the return of Scotland.
the Essence of the proposal of the experts is as follows:
“the Scottish Parliament should convene a National meeting in which will participate all the representatives of Scotland, elected at the national level: a deputies, members of the European Parliament. The national Assembly should declare independence, to turn to other countries for recognition of this step, to reach agreements with Britain and supporting to organize the plebiscite. It is legal, reasonable and consistent with normal international practice”.
There are many articles that explain how Scotland can legally be an independent country without considering the domestic law of the UK.
However, it is worth remembering that there is a huge difference between Assembly of elected representatives and appointed from the best and most worthy. The meeting suggested the Sturgeon, is very different in this respect from Congress.
it is Unlikely that Sturgeon has convened this Congress to declare independence. But the Council of Scotland, members of the European Parliament and leaders of councils will have a clear majority, in terms of population and the great majority in the intellectual sense.
do Not underestimate the dynamics of a new constitutional body, whose members consideredmelt that they control the legitimacy. The convening of this body would become a constitutional innovation. You must make sure that they hear the calls of the huge crowds outside their Windows, demanding radical and rapid change.
