a Government Commission on crime prevention instructed the Investigative Committee of Russia (TFR) and the interior Ministry to consider toughening criminal penalties for unpaid wages, reports the newspaper “Izvestia”.
the TFR and the interior Ministry will appreciate the ability to recognize the actions provided by part 1 and part 2 of article 145.1 of the criminal code “Failure to pay wages…” misdemeanor, and the actions provided by part 3, serious crime.
the Penalty for failure to pay more than two months will increase to five years imprisonment. If the impact of the delays qualify as serious, then the employer faces a penalty of imprisonment for a term not exceeding ten years.
the interior Ministry would give its opinion on this issue after its assessment of present TFR.
For partial non-payment of two months salaries are punishable with imprisonment for two years, and for full-payment — for up to three years. The law also provides the penalty to 500 thousand rubles, community service and suspension of the employer for a period of up to five years.
But the punishment will follow only if the employer did not list the salary of the selfish or personal interests. If the crime was committed for the first time, the employer may avoid criminal liability, to pay off all debts within two months after the initiation of the criminal case.
