the Federation Council has proposed to postpone the adoption of rules on administrative arrest for non-payment of fines to the end of 2020. The corresponding offer contains in the list of measures on improvement of the legislation of Russia in the conditions of epidemic of coronavirus, reports TASS.

the Senators expect soon to make an amendment to the Parliament.

“to Introduce a temporary rule suspending for the period of 2020 the imposition of administrative detention under part 1 of article 20.25 of the Code of the Russian Federation on administrative offences (Cao), for failure to pay an administrative fine within the period stipulated by the code”, — stated in the document.

the Head of the Federation Council Committee on constitutional legislation and state construction Andrey Klishas said that in the conditions of isolation and restrictive measures, not all citizens had the opportunity for the timely payment of imposed on them administrative fines. He reminded that failure to pay a fine within the prescribed period shall entail the imposition of such fine in the double amount, or administrative arrest for up to 15 days, or compulsory work for up to 50 hours.

“However, currently, the administrative code does not include presentation of motions, petitions and complaints by filing them electronically. Thus, the question of granting to the citizen of the deferral or installment payment of the fine can also be not resolved in time. The application of the administrative liability measures, especially measures relating to restriction of liberty, under the circumstances, appear to be disproportionate acts”, — said Klishas.

According to him, the postponement of the introduction of fines would allow more to protect the health of citizens brought to administrative responsibility.
